Reportable Conduct Scheme

From 1 July 2017 – the Reportable Conduct Scheme will apply to all Victorian schools.

The reportable conduct scheme takes effect from 1 July 2017 and requires any allegations of ‘reportable conduct’ against employees (including contractors, volunteers, allied health staff and school board members) to be reported to the Commission for Children and Young People (CCYP) within the legislated timeframe.

There are five types of reportable conduct listed in the Child Wellbeing and Safety Act 2005 (Vic.). These are:

  • sexual offences (against, with or in the presence of, a child);
  • sexual misconduct (against, with or in the presence of, a child);
  • physical violence (against, with or in the presence of, a child);
  • behaviour that is likely to cause significant emotional or psychological harm; and
  • significant neglect.

 

From 1 July 2017, principals should, in the first instance, contact the Industrial Relations Unit as soon as they are made aware of an allegations that may constitute reportable conduct.

The Industrial Relations Unit will provide advice and support to principals on how to manage the matter, including reporting to CCYP (if appropriate) within the legislated timeframe.
